Kyle Medley is a Partner in Hinshaw & Culbertson’s New York office, with over 15 years of insurance litigation experience. Kyle focuses his practice primarily in reinsurance and insurance coverage disputes. He has substantial experience in litigating, arbitrating, and mediating a wide variety of insurance disputes including those involving primary carriers, excess carriers, reinsurers, and Lloyd’s syndicates in run-off. Kyle was recently seconded to a major Lloyd’s syndicate in London, where he worked closely with the cyber claims team, including on issues concerning insurability of fines and penalties.

Kyle joined Hinshaw & Culberson in 2014 as part of the firm’s merger with Barger & Wolen LLP. Kyle is a graduate of the University of Michigan and Brooklyn Law School, where he was Managing Editor of the Brooklyn Law Review. He is admitted to practice in New York, New Jersey and several federal courts.

Cyber Snare? The Insurability of Regulatory Fines
As cyber and privacy regulations proliferate, enterprises face significant compliance risks. Mistakes can be costly; regulators may be empowered to level staggering fines for non-compliance and even shut down information processing until compliance is achieved. Some laws also provide a private right of action for consumer lawsuits. In this panel, we will provide an overview of the regulatory landscape and discuss the different approaches taken by cyber insurers offering regulatory coverage, highlighting significant differences in the coverages provided under various cyber policies, and the insurability of regulatory fines and penalties under a variety of applicable U.S. and foreign laws.
