Ethics Advisory Opinions

ARIAS∙U.S. Ethics Advisory Opinions are prepared by the ARIAS∙U.S. Ethics Committee and are not attributable to individual Ethics Committee members or their employers. Ethics Advisory Opinions are available to all ARIAS∙U.S. members, as well as to the public.

Ethics Advisory Opinions are intended as guidance and are not intended to supplant or contradict the Canons and Comments comprising the ARIAS∙U.S. Code of Conduct (the “Code”). Rather, Ethics Advisory Opinions are designed as explanations of how the Canons and Comments apply to specific circumstances.

The ARIAS∙U.S. Ethics Committee does not pass upon questions of law or matters that are currently in litigation or arbitration; such matters are within the authority of the court or arbitration panel to determine. Ethics Advisory Opinions are intended to assist members with a better understanding of the Code, and are not meant to be relied upon, cited, or otherwise used by parties in any disputes or by courts in construing ethical obligations under the Code. In submitting requests for Ethics Advisory Opinions, ARIAS∙U.S. members are cautioned not to disclose any identifying information or information subject to a confidentiality order, protective order, or similar strictures.

In its discretion, the ARIAS∙U.S. Ethics Committee will provide Ethics Advisory Opinions on its own initiative or in response to questions submitted on Ethics Advisory Opinion submission form (see below). Not every submitted question will be addressed. Questions may be re-stated or genericized.

ARIAS∙U.S. members may submit questions for consideration by using this submission form. By using this form, the submitting member preserves anonymity and the ARIAS∙U.S. Ethics Committee will not be able to identify the submitting member.
